The law lords have upheld a Court of Appeal decision blocking Liverpool Council’s £120m millennium scheme at Chavasse Park. Bill Davies’ Walton Group retains control of the site and is expected to proceed with a £160m shopping scheme.
The decision will be a disappointment to the council, which had planned to establish a £120m National Discovery Park in the city centre.
Lords Nicholls, Clyde and Millett refused leave for any further appeal in the case.
In September, the Court of Appeal held that Rosemary Chavasse Ltd, the council’s preferred developer for the millennium project, had failed to exercise its rights under an option to build on the 2.35ha site.
The decision leaves two of Liverpool’s retail development sites under Walton’s control – the other is the old Post Office at Whitechapel.
