Former Brixton Estates chief executive Tim Wheeler was today awarded two weeks‘ pay for unfair dismissal, but failed to secure further compensation following a bitterly contested case at the Central London Employment Tribunal.
The tribunal said: “Our first finding is that the dismissal was automatically unfair, meaning that the claimant is entitled to a basic award but will not be awarded compensation.
“We support the respondent’s arguments that the reason for dismissal was the irrevocable breakdown in relationships and loss of trust and that there was 100% chance of fair dismissal if there had been a fair procedure.
“The reasons for the dismissal were clear and potentially fair.”
The tribunal supported the respondent’s arguments that Wheeler had put his personal concerns above the needs of the company and pursued his pension rights with “single-minded determination” from January 2009. As a result, his colleagues became despondent about his attitude to the company.
