Homeowners renting out their flats on Airbnb and similar websites are likely to be in breach of the law, the Upper Tribunal’s Land Chamber has ruled.
Those with leases stating that the property can be used as a private residence only, a common clause in leases, cannot rent out their homes short term, it said.
For a property to be used as a private residence, there must be a degree of permanence beyond being there for a weekend or a few week nights. Short-term lettings necessarily breach the covenant, judge Stuart Bridge said.
