East Sussex County Council have failed in their challenge to a ruling in July 1999 that Reprotech (Pebsham) Ltd, which owns and operates the waste treatment plant and household waste site at Pebsham, East Sussex, is entitled to use the site for the generation of electricity subject to noise conditions.
Aldous and Henry LJJ agreed with the High Court that the 1991 planning resolution by the council on the matter amounted to a statement in writing that no further planning permission was necessary to use a turbine for the generation of electricity for export.
