Arrowcroft is making history in Scotland with its attempt to halt the sale and development of Cumbernauld town centre after being fired by the new local council.
Director Nicholas Hai said the developer has been granted an inhibition which will stop the council from granting any security over the land required to carry out the scheme. It is similar to the caution in English law which is placed on property during a dispute.
Arrowcroft lost its right to develop the site when North Lanarkshire council took over from Cumbernauld Development Corporation last year following local government reorganisation.
Last November Arrowcroft served a writ on the new council after North Lanarkshire hired Healey & Baker to re-market the 8.49ha (21 acre) site for 23,225m2 (250,000 sq ft) of shopping and leisure.
North Lanarkshire said that the inhibition would not affect the development for long. A court hearing was due as Estates Gazette went to press. The damages case, however, is likely to go on for some time and is expected to run into millions of pounds.
