The case of County NatWest Ltd v Barton and others has finally concluded after the House of Lords refused leave for the bank to appeal against a Court of Appeal ruling that it could not call in loans advanced for the purchase of leisure property. The appeal court reached its decision on the ground that the borrowers guarantees, on which the bank was suing, were vitiated by the fraud of the bank manager in deliberately misleading the borrowers as to the value of the properties.
