Campaigners have lost their claim that the government acted unlawfully in giving the go-ahead for the £700m Birmingham Northern Relief Road.
Mr Justice Latham gave the plans for building the first private toll motorway legal clearance.
The campaigners are now considering an appeal against the High Court decision.
