Birmingham City Council has approved plans for the £160m BTR skyscraper at One Eastside for the second time, after the previous consent was nullified by an error at the committee.
Developer Court Collaboration was forced to resubmit plans, after the council failed to include all objections at the planning committee a year ago.
Last summer, neighbour and rival investor LaSalle IM called for a High Court challenge arguing that the council has failed to properly consider heritage issues when debating the 51-storey tower.
Birmingham City Council admitted the mea culpa and asked for Court to lodge plans for a second time last December, a year after the original consent was granted.
The committee has now reapproved the plans for 667 flats and amenity space next to the HS2 station on Curzon Street. The city’s first skyscraper will include residential gardens and courtyard spaces with a gym, cinema and sky lounge.
