Bridlington businessman fails to stop tree preservation order

The owner of a leisure complex in Bridlington has failed in his High Court bid to challenge a tree preservation order that protects some 10,000 trees in woods surrounding the complex at Marton Hall, Marton, Sewerby, Bridlington.

He claimed that the order issued by East Riding Yorkshire Council, interfered with his plans to build an access road to facilitate the use of part of his land as a touring caravan business. He further claimed that the council had relied upon an out-of-date Ordnance Survey map to make the order, which he claims, was issued only to strengthen the council’s position at a public inquiry.

Dismissing Mr Robinson’s challenge, Sullivan J said that the council had not been wrong to rely upon an outdated map, and that their actions should not be equated with their seeking to bolster their position at a planning inquiry.

Mr Robinson now faces a legal bill in the region of £12,000.
