Bryant Homes is challenging the DoE over housing requirements in Stratford-upon-Avon after being refused permission to develop housing in an area known as Clopton Fields.
In the High Court the DoE argued that there was sufficient land elsewhere for development. Bryant said the DoE was contradicting its earlier position that there was a shortfall of over 25% of land allocations necessary to meet the approved Warwickshire Structure Plan.
Bryant also challenged a planning inspector’s report that said the development would harm the setting of listed buildings on the site – Clopton House and Clopton Tower, built in 1843 and 1856.
Judgment has been reserved in the case.
