Cheshire East council is to lodge a legal bid to try and overturn planning for 200 homes in Congleton.
It wants to reverse a planning inspector’s decision to back the scheme on the 42-acre Loachbrook Farm.
The council threw the plans out over fears of loss of agricultural land.
Cheshire said it planned to fight the decision based on national policy, as UK towns and villages came “under siege from an unprecedented onslaught of unplanned development proposals”.
It added: “As an authority we are saddled with unrealistic housing targets from an unaccountable regional planning system. Cheshire East council recognises this legal action will cost money – but believe we have no choice but to challenge this ruling.”
