Council challenged over rejection of development plans

Great Yarmouth Borough Councils decision to scrap plans for residential development on land at Filby has come under challenge at the High Court.

Norwich-based East Anglia Property Ltd, which owns 2ha of land at Thrigby Road, Filby, claims that, in their draft plan, the council had made provision for five homes to be built there, but had later rejected the plans following local objections.

East Anglia Property claims that the council failed to give proper, adequate and intelligible reasons for rejecting the recommendation of a local planning inspector, who had found that there was nothing inappropriate about the plans.

The company is asking Gibbs J to quash the part of the new Great Yarmouth local plan that relates to the non-allocation of its land for residential development.

The hearing continues.
