Bradford Metropolitan District Council have been ordered to pay the legal costs of their failed appeal against Yorkshire Water Services Ltd.
Last month, Bradford Metropolitan District Council failed to convince the High Court that Yorkshire Water was responsible for the £5,000 cost of fixing a Cullingworth resident’s sewage problem, and the challenge was dismissed.
Despite losing the appeal, the council had argued that they should not pay the legal costs as they had acted honestly and reasonably, and had made “sound administrative decisions in the public interest” by way of appealing. They further added that the case served to clarify a point of law.
ALIGN=”JUSTIFY”>In dismissing their claim, Brooke LJ said: “They appealed and lost, and they should pay Yorkshires costs of appeal.”
