Couple given leave to challenge Imperial Wharf development

The Law Lords have now considered a test case concerning the obligations of local authorities to curb development plans if they pose a threat to the health of local residents.

Senior Law Lords, Lords Bingham, Steyn and Hope have granted chronic diabetic Robert Burkett, and his wife, leave to mount a House of Lords challenge.

The Burketts, who live in a ground floor maisonette in a three-storey block adjacent to the proposed development at Imperial Wharf, claim that the building work will disturb land that was contaminated during its former use by British Gas, and that this will affect the health of Mr Burkett and his asthmatic daughter.
