Court issues fresh guidance on moving gypsies

New Court guidance has been given on the stance courts must take when faced with the problem of moving gypsies off sites they occupy without planning consent.

South Buckinghamshire council sought an injunction to move gypsies from a greenbelt site they occupied in breach of planning consent.

The gypsies challenged the grant of an injunction.

They also argued that even if an injunction was granted it would not be appropriate to order them off prior to a decision on an application for planning consent that they intended to make.

However, ruling that the council was entitled to the injunction, Mr Justice Penry-Davey said there had been flagrant breach of planning regulations and the gypsies were aware of this.

He said they had not co-operated with the council and that ordering them off the site was both appropriate and proportionate as a remedy.
