Derbyshire waste landfill site to remain operational

A Derbyshire villager has failed in his bid to prevent a waste landfill site near his home from being used for another year.

David Murray, who lives close to the Hall Lane landfill in Barrow Hill, near Chesterfield, claimed that villagers have suffered for years from odours, noise, dust and fumes from the site.

He argued that plans to extend the site brought it closer to a primary school, and would result in disruption to public footpaths that he uses to walk his dog.

Murray challenged Derbyshire County Council’s decision to grant planning permission for the site to remain operational for another year, but his challenge was dismissed by the High Court in October 2000, and that decision has now been upheld by the Court of Appeal.

The planning permission allows Fitzwise Ltd – the firm that runs the landfill – to extract another 120,000 tonnes of clay from the site. It also enables it to create a new waste “cell” with a capacity for 650,000 tonnes of putrescible waste.
