Developers fail to challenge revised structure plan

Two developers from Swadlincote and Loughborough have failed in their High Court challenge to the revised Warwickshire County structure plan, which threatens their plans to build homes on land that they own near Rugby.

JS Bloor (Northampton) Ltd, of Ashby Road, Measham, Swadlincote, Derbyshire, and William Davis Ltd, of Forest Field, Forest Road, Loughborough, Leicestershire, asked the court to quash proposals in the plan that, they claimed could affect their development of land off Back Lane, Long Lawford, Rugby.

The developers argued that modifications made to the structure plan before its ultimate adoption meant that the previous policies were changed, and that previous allocations are no longer protected.

They claimed that, as a result of the revision, the status of their site, and its suitability for housing development, will have to be reviewed.

However, Richards J today rejected the developers’ claims and held that the structure plan should be left intact. He said that the developers’ case had “failed on all grounds” and should be dismissed.
