A dispute over the ownership of a fence and a 12ft gateway in East Sussex has been settled in the High Court today.
Landowner Leonard Newby, of Scheveningen-huis, Ashdown Road, Forest Row, claimed that plans by a neighbouring company to erect a house on its plot of land and to install a new access onto Mr Newby’s driveway, over which the company, MIW holdings Ltd has a right of way, breaches a 1994 deed giving him control over the boundary fence and gateway.
The judgment given by Deputy Judge Anthony Elleray QC means that Mr Newby has triumphed only to a “very limited extent” in relation to ownership of the fence, as MIW will be able to carry out its plans to build the new access.
