Homebase seeks to take underletting dispute to House of Lords

Following its failed May 2002 Appeal Court attempt to overturn a High Court ruling, in which Allied Dunbar succeeded in blocking the underletting of a DIY store, Homebase is now seeking permission to take the dispute to the House of Lords.

Allied Dunbar is the freehold owner of the premises in Bilston Road, Wolverhampton. In 1998, Its tenant, Homebase, decided to close down its operation and to dispose of the unexpired residue of the lease. Homebase claims that Allied Dunbar has unreasonably withheld consent for the underletting.
