A London housing association has succeeded in a High Court claim in which it said that it had been misled into granting a Wycombe property to a father and son by the fathers inaccurate claims that he owned no title to any other property and needed a “helping hand onto the property market”. As a result, the son faces eviction.
Northcote Housing Authority had asked Deputy Judge Sonia Proudman QC to set aside the 99-year lease of 113A Gordon Road, Wycombe, which it had transferred to Karl Dixon for him to live in with his father, Paul, in exchange for a £35,000 down payment and an annual rent.
The judge has ruled that the association was entitled to rescind the lease because of the misrepresentations made by Paul Dixon on the application form, and because Karl Dixon effectively lent his hand to the misrepresentations by signing his own name at the bottom of the form.
