Landlord sues former tenant over dilapidation of industrial unit

A landlord is claiming for damages against the tenant of an industrial unit in Chasetown, who failed to yield up the property in a state of good repair.

Landlord, LCP Estates, is suing former tenant Patrick Burton for £92,123.43. It claims that Burton breached the terms of his 25-year lease by failing to arrange for premises at unit 3C Chase Park Industrial Estate, Cannock Road and Plant Lane, Chasetown, Staffordshire, to be yielded up in good repair.

According to LCP’s High Court claim, the unit was leased to Triform Precision in June 1974, but Burton covenanted that the tenant would perform all its obligations under the lease and that he would assume responsibility for payment of the rent should Triform fail to pay. The lease expired in June 1999.

LCP Estates alleges that Burton, whose last known address was 49 Peartree Drive, Birmingham, received a demand for the cost of dilapidations but has since failed to pay anything towards the cost.

The claim was issued by Goldsmiths of Jermyn Street.
