London couple seek to preserve their right to light

A London couple have issued High Court proceedings in an attempt to prevent their neighbours from building a new house in their garden, which, the couple claim, will devalue their home by £250,000.

Robert and Linda Seward, of 47 Kingstown Street, London NW1, claim that the proposed development will interfere with their right to light, particularly affecting Mrs Seward’s use of an area by a window where she sits to sew quilts.

The Sewards are to ask the High Court to rule that the new house, planned by the Springetts, who live next door, at 58 Regents Park Road, will be an actionable interference with their right to light, and a nuisance. They are seeking an order banning the Springetts from proceeding with the planned development.

The Sewards contend that they have a right to light, acquired through their enjoyment of light at the property for more than 20 years, and that this will be hampered if the Springetts are allowed to go ahead with their plan.
