Moto sues over asbestos threat at Bristol services

The owner of a motorway service station near Bristol is suing for damages of more than £100,000, after a contractor allegedly left part of the property extensively contaminated with asbestos.

According to the claim, which has just been made publicly available, Moto Hospitality, owner of the Severn View Motorway services on the M48 near Bristol, called in M&G Hill (Environmental Engineers) to remove asbestos from the transport drivers restaurant and on-site garage workshop.

Moto claims that M&G quoted £11,250 plus VAT for the work, which it later revised to £12,375, but did not remove all the asbestos from the building.

In October 1999, a report commissioned by Moto found that the transport drivers restaurant and garage remained extensively contaminated with asbestos that had been disturbed or not fully removed from the building while the remedial works were being carried out.

Moto claims that it had to employ another contractor to remove the remaining asbestos and to decontaminate areas of the building. It alleges that M&G breached the contract by failing to remove the asbestos, and failing to carry out the work in a good and workmanlike manner.

It is claimed that an investigation and report into the continued presence of asbestos cost more than £30,000, while management costs and asbestos-removal costs amounted to more than £70,000.
