A Northamptonshire farming company has failed in last ditch moves to reduce the pollution which, it says, is produced by a nearby pet crematorium.
Family-run Thornby Farms Ltd has been refused permission go to the House of Lords to challenge the Court of Appeal’s refusal to overturn a local authority’s decision authorising Timeright Ltd to increase the total capacity of its animal incineration facility at Guilsborough, Northamptonshire, to 650kg per hour.
Thornbys claim was rejected by the High Court in July last year, and that decision was upheld by the Court of Appeal in January 2002 (see R (on the application of Thornby Farms Ltd) v Daventry District Council [2] EWCA Civ 31; [2002] 05 EG 132 (CS)).
