Protesters today failed to block the £700m Birmingham Northern Relief Road in the Court of Appeal.
The court upheld a High Court decision in 1998 that gave the go-ahead for Midland Expressway’s 27-mile toll road.
A spokesman for Midland Expressway said that work would now be resumed on the road.
