Sewage outflow at Westward Ho! under challenge

The DETR and South West Waters compulsory purchase of land for sewage disposal at Cornborough, West of Bideford, Devon, is under challenge in the High Court today.

Objectors claim the sea outfall would be close to the beaches of Westward Ho!, and are calling for the outfall to be located further out at sea. The beach is an EU-designated safe bathing area.

The hearing continues and is expected to last for three days.

Robert McCracken (instructed by Toller Beattie, of Barnstaple) appeared for the applicants; Richard Drabble QC (instructed by the Treasury Solicitor) appeared for the first respondent, the Secretary of State for the Environment, Transport and the Regions; Robert Fookes (instructed by the solicitor to South West Water) appeared for the second respondent.
