The High Court ruled yesterday that arbitration proceedings could begin to claim back £40m that VHE Construction lost in a road building project in the West Midlands.
VHE incurred the costs through technical difficulties and delays. It claims the original £5m earthworks contract for the Leabrook Road site required 72 mine shafts to be capped. It found 1,200 in the former coal mining area. The employer, the Black Country Development Corporation, has disputed the costs.
