Essex-based contractor Breyer Group has filed a winding-up petition against Robert Whitton’s ROM Capital.
The petition relates to work done by Breyer on a 38-flat scheme in Harlow, Essex.
The £3m Adams House was completed in April 2009. Breyer is awaiting payment from ROM for the work. The petition is due to be heard on 17 March.
ROM developed the scheme for East Thames and is understood not to have been paid the full amount by the affordable housing group.
Trevor Burns, assistant director of development at East Thames, said: “East Thames Group has paid ROM Capital the full contracted price.
“We have withheld some liquidated and ascertained damages due to a delay in the building’s completion, which is in accordance with our contract. We are negotiating with ROM on this issue, but we are unaware of the details of the dispute between ROM and Breyer Group.”
